Terms and Conditions for Artijam 90-Day Pilot Phase

Please read the following disclaimer and agreement carefully before proceeding. By participating in this Minimum Viable Product (MVP), you acknowledge that you have read, understood, and agreed to the terms and conditions outlined below.
The product launch you will participate is in MVP/ pre-full production phase. As such, it may contain vulnerabilities, bugs, or other issues that could affect your system's performance and security. Artijam gives no warranty and accepts no responsibility or liability for the accuracy or completeness of the information and materials contained in this web application. 

Introduction

Welcome to Artijam, a platform dedicated to supporting individuals within the creative economy, including craft vendors, content creators, and participants in the tourism value chain. By accessing or using our services during this 90-day pilot phase, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
 

Data Sharing and Privacy

1. Data Sharing: By participating in this pilot phase, you consent to share your personal data with Artijam. This data may include but is not limited to your name, contact information, and any other relevant details necessary for the operation of our services.
  
2. Data Security: While we commit to implementing robust security measures to protect your data, you acknowledge that no method of transmission over the internet or electronic storage is 100% secure. Therefore, you agree that Artijam cannot be held liable for any unauthorized access to or use of your data during this 90-day period. 
2. By participating in this Pilot Phase, you acknowledge and accept any risks associated with using the product demo. Under no circumstances will Artijam be held responsible or liable in any way for any claims, damages, losses, expenses, costs, or liabilities whatsoever (including, without limitation, any direct or indirect damages for loss of profits, business interruption , data loss, system instability, security breaches or loss of information) resulting or arising directly or indirectly from your use of or inability to use this web application or any websites linked to it, or from your reliance on the information and material on this web application, even if the Artijam were advised of the possibility of such damages in advance.
   3. Data Breach Disclaimer: In the event of a data breach, although we will take all reasonable steps to mitigate the impact and notify affected users promptly, you agree that Artijam shall not be liable for any damages resulting from such a breach.
    User Responsibilities
- You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- You agree not to use the platform for any unlawful purposes or in a manner that could damage, disable, or impair the services.
   Intellectual Property
   All content provided on Artijam remains the intellectual property of Artijam or its licensors. Users may not reproduce, distribute, or create derivative works from any content without express written permission from Artijam.
   Limitation of Liability
   Artijam will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any related services.
   Modifications
   Artijam reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the services after such changes constitutes your acceptance of the new Terms and Conditions.
   Governing Law
   These Terms and Conditions shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising out of or related to these terms will be resolved in accordance with applicable law.
